Terms and Conditions
1. Introduction
1.1. These Terms and Conditions create a legally binding agreement (“Agreement”) between you (“User”) and PlanB Telecommunications, regarding your purchase of an international data plan (“Data Plan”) associated with a prepaid eSIM (“eSIM”), for use on your personal device (“Device”) from PlanB (the “Service”).
1.2. Future agreements between you and PlanB may include additional terms and conditions or documents posted on our website or app (the “App”).
1.3. We suggest printing a copy of these Terms and Conditions for reference.
2. Registration
2.1. Users can register to purchase an eSIM via our App. You must accept these Terms of Use to proceed with the purchase. PlanB's Privacy Policy and Cookies Policy are displayed in the App during registration.
3. Purchase and Activation of eSIM
3.1. By purchasing an eSIM from us via the App, you agree to pay all applicable charges for the selected Data Plan.
3.2. You are responsible for the eSIM once it is delivered. If your Device is lost or damaged before you’ve completed payment, you are still liable for the full eSIM cost.
3.3. You may also purchase eSIMs from PlanB’s partners (“Third Parties”). In such cases, your agreement is with the Third Party, and PlanB is not a party to that contract.
3.4. PlanB offers Data Plans for specific countries and reserves the right to limit their availability in certain jurisdictions. Users can browse, select, and purchase Data Plans through the App or Third Parties.
3.5. To use the Service, you confirm that your Device is unlocked and eSIM-compatible.
4. Duration and Termination
4.1. This Agreement begins when you purchase the eSIM. The eSIM will remain on your Device after the Data Plan expires or runs out. You can delete the eSIM anytime, though we recommend waiting until your Data Plan is fully consumed or expired. A stable internet connection may be required for eSIM activation.
4.2. The Agreement lasts until your Data Plan expires or the data credit is depleted.
4.3. The Agreement terminates immediately if:
4.3.1. Your Data Plan is consumed or expires;
4.3.2. PlanB suspends your eSIM or Data Plan due to a breach of these Terms or applicable laws.
4.4. If the Agreement ends and you don’t delete the eSIM, it will remain on your Device "as is" without warranty, until you purchase a new Data Plan, at which point these Terms will apply again.
5. Warranty
5.1. These Terms are in addition to your statutory rights as a consumer.
5.2. PlanB provides no warranties or representations about the eSIM or Service, except those required by applicable law.
5.3. PlanB reserves the right to discontinue any eSIM sale, service, or support at any time.
6. Service Availability
6.1. PlanB will take reasonable steps to ensure the Service is available, subject to network capacity and service provider availability.
6.2. We work with various network service providers, which differ by location.
6.3. “Unlimited” Data Plans may be subject to the network provider’s fair usage policies, which can limit data speed or usage if excessive or harmful to other users.
6.4. PlanB does not guarantee uninterrupted Service, especially in circumstances like:
6.4.1. Network maintenance or upgrades by our service providers;
6.4.2. Lack of network coverage in certain areas as outlined in your Data Plan;
6.4.3. Disruptions beyond our control, such as Device issues, regulatory requirements, or environmental factors.
7. User Obligations
7.1. You agree to:
7.1.1. Use the eSIM according to these Terms;
7.1.2. Follow all applicable laws in your location;
7.1.3. Refrain from fraudulent, illegal, or network-damaging activities;
7.1.4. Not distribute PlanB’s proprietary information without permission;
7.1.5. Avoid using excessive amounts of data;
7.1.6. Respect third-party intellectual property rights.
7.2. Credits, promotions, and referrals must not be exploited to undermine the Service's fairness or operation.
7.3. PlanB may suspend Service for breach of these Terms, and you will be responsible for all charges incurred during suspension.
7.4. PlanB reserves the right to remove a User’s account or disqualify them from future use or promotions without liability.
8. Payment Terms
8.1. Users can purchase eSIMs through the App, with payment processed by PlanB’s authorized agent.
8.2. All eSIM purchases are prepaid and inclusive of indirect taxes, unless otherwise stated.
8.3. “Indirect Taxes” refer to sales tax, value-added tax, or similar levies.
9. Legal Right of Withdrawal
9.1. Consumers have the right to withdraw from the Agreement within 14 days of purchase, unless the eSIM is activated. If activated, partial refunds may apply.
9.2. To withdraw, please contact PlanB Customer Support.
10. Refunds and Returns
10.1. If the Service is not provided as expected or violates your statutory rights, you may be eligible for a refund.
10.2. Full refunds are available if:
10.2.1. The eSIM was purchased directly from PlanB;
10.2.2. The eSIM is not activated;
10.2.3. The purchase was made within the last 6 years.
10.3. Partial refunds may be available in the event of issues like network failures.
11. Intellectual Property
11.1. All content, software, and trademarks associated with the eSIM or App are owned by PlanB or its licensors.
11.2. No part of the eSIM, App, or associated content may be reproduced or exploited without PlanB’s permission.
12. Data Protection
12.1. By purchasing an eSIM, you acknowledge that PlanB will process your personal data in line with our Privacy Policy and Cookies Policy.
13. Indemnity
13.1. You agree to indemnify PlanB against any claims, losses, or damages arising from your breach of these Terms or misuse of the Service.
14. Limitation of Liability
14.1. PlanB limits its liability to the cost of the eSIM or Data Plan paid by you within the 12 months prior to any claim. This does not affect liability for fraud or matters not allowed to be excluded under law.
15. Governing Law and Jurisdiction
15.1. These Terms are governed by Irish law, and disputes are subject to the exclusive jurisdiction of the courts of Ireland.
15.2. Local laws may also apply depending on your location.
16. Changes to Terms
16.1. PlanB reserves the right to modify these Terms. Updates will be posted on our App, and you’ll be notified in advance of significant changes.
17. General
17.1. PlanB may assign its rights and obligations under this Agreement to another company within its group.
17.2. If any provision of this Agreement is found illegal or unenforceable, it will be modified to remain enforceable.
17.3. Any delay in enforcing these Terms is not a waiver of our rights.
